Our terms and conditions (covering delivery, business dealings and payments)

Lautsprecher Teufel has been in the mail order business for many years, and thanks to this experience, we‘re in a position to provide the best terms of privacy and satisfaction to you, our customers. We guarantee you that not only will your order be processed as quickly as possible, but your privacy and the information you provide us will be treated with the strictest confidence. Lautsprecher Teufel has the following terms governing deliveries, business dealings and payments for all contracts. Please note that the version of the Terms & Conditions valid at the time of your order is applicable.

1. General information/Conclusion of contract

The requirements of the German Civil Code (BGB) are applicable to any business dealings with Lautsprecher Teufel GmbH. When you place an order online, you will automatically be sent a confirmation notification e-mail for your order which will also inform you of your right of return. This e-mail does not indicate an acceptance of a contract, however. After reviewing your order, we will send you a binding contract as a PDF file to your e-mail address.The contract is accepted when we send this order confirmation PDF file. This order confirmation also contains information on the expected delivery date. When you order online, you agree to the information that you provide us being stored by us. Please contact us if you misplace the documents pertaining to your order; we will gladly provide you a new copy. Your contracting partner is:

Sales of loudspeakers, amplifiers and electronic components from Lautsprecher Teufel are limited to usual and reasonable quantities. Upon concluding the contract, you agree to purchasing the items for personal use only. Any commercial resale of items without prior approval from Lautsprecher Teufel is not permitted. Any infringement of this provision carries a penalty of € 2,500 payable to Lautsprecher Teufel. Furthermore, Lautsprecher Teufel retains the right to refuse sales of items made by Lautsprecher Teufel to persons violating the above-mentioned provision.

2. Right of return
a) Statutory right of return

Customers (as defined by § 356 of the BGB) are agreed to have the following legal rights of return of products.

Right of return
You are entitled to return items that were delivered to you without stating a reason within two (2) weeks of delivery. The period of return begins after the receipt of your order in text format (i.e. as letter, fax, e-mail), but not before your receipt of the products and also not before the fulfillment of our duties to inform the customer in accordance to § 312c Abs. 2 BGB in connection with § 1 Abs. 1, 2 and 4 BGB-InfoV as well as our duties in accordance with § 312e Abs. 1 Satz 1 BGB in connection with § 3 BGB-InfoV. Only with items that cannot be returned by parcel post (i.e. too large, etc) do you need to declare your desire to return the items in writing. The items must be returned or this declaration must be sent on or before the appropriate date to observe the period deadline. We assume the costs and risks of returning all items.

Please note that the items will be picked up at your address by our shipping company when you choose to return within the two (2) week period.

Consequences of the return
If you have exercised your right of return, any benefits received by either party shall be restituted and, if necessary, derived advantages (e.g. benefits from use) shall be refunded. We have the right to claim compensation for the value of an item if the value has been adversely affected. This does not apply if the damage to the item was caused solely by testing the item – the type of testing that might take place in a retail store. You can avoid the obligation for value replacement if you do not use the item as if you owned it and refrain from acts that would affect its value. Obligations to refund payments must be fulfilled within thirty (30) days.This period for you begins on the date that the item or notice of return is sent; for us it begins upon receipt.

Financial transaction
If you financed this contract with a lien and make use of your money back guarantee, you are no longer bound by the loan contract if both contracts are economically binding. This especially applies if are co-signers on the loan, either directly or indirectly in partnership with the financing institution. If the loan has already been applied to us at the time of revocation of the contract, or initiation of the right of return, your lending instititution will be obligated to meet the terms and conditions outlined in our contract regarding revocation or right-of-return.

Exceptions to the right of return
According to § 312d Abs. 4 the exception for right of returns for long-distance contracts are:
1. You are not entitled to return items that were made especially to customer specifications or were clearly tailored to suit the specific needs oft he customer.
2. You are not entitled to return orders with audio or video recordings or software if you have broken the seal on the data carrier.

b) General information on returns

aa) It would be best if you first informed us of your intent to return the product by calling us at 00800 200 300 40. This would aid us in allocating and processing your return, and helps us, in turn keep costs to a minimum – which in the end benefits you, our customer.

bb) You may only return individual components from a set if Lautsprecher Teufel offers these components for sale separately. If one or more individual components are returned from a set, this voids the discount that Lautsprecher Teufel provides on the sale of the compoents as a set. Thus for individually reurned components from a set the customer will be refunded the difference between the set price and the total purchase price of the individual components you decide to keep (i.e., we will deduct the discount that applies to set purchases.) For example, the set costs € 500,- but the total cost of the individual components would have been € 700,- (satellite speakers for a price of € 450,- and the subwoofer for € 250,-). If you return the subwoofer, you receive would receive € 50,-, or the difference from the € 500,- set price and the € 450,- satellite price. If you returned the satellite speakers, you would receive € 250,- as a refund – the difference between the € 500,- set price and € 250,- . the sum purchase price of the subwoofer you decided to keep.

cc) Please avoid damaging the item and/or its packing, and return the item to us in its original packaging if at all possible, including all individual accessories and any packaging pieces. If you no longer have the origincal packaging, please choose materials that will provide effective protection to prevent damage in transit. We would greatly appreciate it if you would use additional outside protective packaging where needed and/or necessary.

dd) Please note that the information in paragraphs b) aa) – cc) are not required for the working of the right of return.

c) Contractual right of return

Above and beyond the legal right of return under 2a), Lautsprecher Teufel also extends a contractual right of return that begins on the day immediately following the last day of the two (2) week period and lasts eight (8) weeks after the receipt of the items by you. You may exercise your right of return as long as the item is in proper condition and will be returned in a proper, undamaged state.

Before returning items, please call the service hotline at 00800 200 300 40. Then please have ready the batch number of your device (found on the back of the device, such as MO 04007480121A) as well as the invoice number (found on the sales slip that came with the product or the PDF document that was included in your order, for instance 4322543).

After notifying us of your contractual right of return, you may ship the item back to Lautsprecher Teufel. Please note that you shall assume the cost of shipping the item and any risk of damage to or loss of the item in transport.

3. Warranty and guarantee
In addition to the statutory warranty, we provide you the following: Lautsprecher Teufel GmbH provides a twelve (12)- year warranty for loudspeakers and a two (2)- year warranty for amplifiers and electrical components, starting at the purchase date. The warranty covers all materials and time needed. It does not cover devices damaged as a result of improper use or electrical/mechanical overloading. The original Teufel invoice is your proof of warranty. This warranty applies exclusively to loudspeakers, amplifiers and electronic components purchased by consumers from Teufel for private usage. The warranty does not apply to loudspeakers, amplifiers and electronic components sold to you, the customer, through third party dealers. For third-party products supplied with the Teufel system, the terms of warranty of the manufacturer in question apply. When Teufel products are resold privately, the warranty may be transferred to the new owner by providing them the original Teufel invoice.
Please note that the implementation of a Teufel warranty claim will not prolong or renew the time of coverage.

4. Terms of delivery
We deliver to the following countries: Austria, Belgium, the Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Greece, Great Britian, Ireland, Italy, Lichtenstein, Luxemburg, the Netherlands, Norway, Portugal, Slovenia, Spain, Sweden and Switzerland.

Delivery to your doorstep (kerb-side). The customer is responsible for additional labour and transport costs.

Delivery of large sized orders are handled through forwarding agent and shipped on a disposable pallet. This pallet remains with the customer who will dispose of it as domestic waste or in a recycling centre.

5. Payment methods
Within Germany: To ensure a safe and secure payment, you are able to pay cash on delivery, credit card or through bank transfer within Germany. Cash on delivery requires a € 2, - immediate extra fee, which is additional to the amount due noted in the confirmation of order e-mail. This is a DHL delivery fee for thecash on delivery and is not noted on the Lautsprecher Teufel bill you receive. For example, the shipping fee for the particular system you’ve ordered is € 111,50, thus you would pay € 113,50.

Outside Germany: International shipments are payable via credit card, Direct eBanking and ClickandBuy. Please check the available payment methods for your country.

6. Shipping costs Germany
The shipping costs are not included in the sales price of the article. Every article has an individual shipping cost. This shipping cost are based directly upon the size, weight, packet number, product group, shipping company and price of the product. The shipping costs are different whether shipping within or without Germany. What is most important is the actual shipping location, not the address where the order originates. The total price is subject to change when further components are added.

Accessory items are, within Germany, free of shipping costs. That goes for all accessories in the following categories: spikes and resonance dampers, wall mount brackets, cable sets, loudspeaker cables, connection cables, tools and DVDs, fan shop articles as well as the base M 50 P speaker stands. For all other speaker stands you must pay a one-time shipping fee of 9.90 - regardless the actual amount of speaker stands you've ordered. For all other speaker stands you must pay a one-time shipping fee of 19.00 - regardless the actual amount of speaker stands you've ordered.

Higher shipping costs are included for orders from the German East and North sea islands. Please speak personally with one of our sales consultants under 00800 200 300 40.

7. International shipping costs
We are happy to send our systems also outside of Germany through UPS or another forwarding company.

For shipping outside Germany there are other transport costs included. These are oriented based upon the size, weight and extent of the order. For the respective product or for a complete order the associated costs can always be seen by clicking on the „shipping information“ link inside the product information itself, or by placing the wished-for articles in the shopping cart and then click the „View Cart“ link.

For accessories the following shipping costs are relevant:
By accessory articles there is a one-time shipping fee of € 9,00 – regardless of the number of accessory articles. This applies to all articles in the following categories: spikes and resonance dampers, wall mount brackets, cable sets, loudspeaker cables, connection cables, tools and DVDs, and fan shop articles. For all other speaker stands you must pay a one-time shipping fee of 19.00 - regardless the actual amount of speaker stands you've ordered.

No German taxes will be applied to orders from Switzerland, Lichtenstein or Norway. Swiss customers receive the swiss tax addition and the import tax upon reception of the articles from the delivery person.

Please note: The higher shipping costs for outside Germany are based upon the particular standard rates of the shipping company that we, without further costs, directly pass forward to you. Naturally the same great advantages apply for those customers outside Germany: the Teufel Service assurances such as eight week right of return as well as the 12 year guarantee!

8. Retention of title
The sale occurs under retention of title. The item remains the property of Teufel until payment of the purchase price is made in full.

9. Minimum order value
A minimum order value (also for accessories) of € 25,- is applicable to all orders.

10. Teufel EasyPay and Installment plans
Within Germany: Teufel EasyPay makes it possible for you to purchase, on monthly credit instalments, Teufel products. Teufel EasyPay is available only in Germany starting with purchases of € 500,-. The downpayment is one-third of the total purchase price, with the monthly minimum instalment € 50,-. The payment total must be completed within 12 months, with total purchases of € 2500,- receiving 24 months to complete their instalments. The interest annual percentage rate is, at present, 8,99 % (as of August 2008). For further information, contact our sales representatives at 00800 200 300 40.

11. Custom-made products
Custom-made products that were produced or modified at your special request (including individually assembled or cut-to-length cables) cannot be exchanged or returned.

12. Privacy notice
The personal information you give us will only be used to process your order. We adhere to the regulations regarding data storage and processing as laid down by the German Data Protection Act (BDSG) and the Teleservices Data Protection Act (TDDSG).

We do not share your personal information, including your address and e-mail address, without your express prior consent. You also have the right to revoke your consent to sharing information with third parties at any time. Our third-party service providers are the sole exception. They require this information to process your order (e.g. the shipping company that we commission for delivery as well as the financial institution and credit card company processing the payment transaction). In these cases we limit the scope of the information we transmit to the bare minimum.

All of the personal information you enter when making a purchase will be encrypted on your computer before it is sent to us. We use Secure Socket Layer (SSL), the proven method for encryption. This trusted method is commonly used in online shopping to offer consumers the highest level of protection when processing their order information, account details and credit card numbers.

13. Place of jurisdiction and applicable law
Inasmuch as the customer is a merchant in terms of the German Commercial Code (HGB) or a corporation under public law, the exclusive place of jurisdiction for all claims pertaining to the business relationship shall be Berlin. German law is applicable to contracts subject to these Terms and Conditions to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For agreements relating to a purpose that cannot be attributed to the professional or corporate capacity of the entitled person (consumer), this choice of applicable law is only valid inasmuch as the protection afforded is not revoked by mandatory regulations of the country in which the consumer has his/her ordinary residence.
